You might not do it again when you discover it could lead to a fine of up to £5,000!
Following weeks of glorious sunshine and scorching hot temperatures in the UK, the short spell of cooler weather and heavy rainfall that many parts of the country are experiencing this week might come as a welcome relief for some people but may also lead to trouble for a number of drivers.
With the wet weather comes puddles, which tend to form in many places along the side of the road and more often than not it’s difficult to avoid them when you’re driving.
However, what many people don’t know, is that a serious punishment can be issued to any motorist who drives through a puddle and splashes a pedestrian or a group of pedestrians.
Any driver caught splashing a pedestrian because of driving through a puddle could be issued with a fine of up to £5,000!
Being charged for ‘driving without reasonable consideration’ does carry a maximum level five fine.
Section three of the Road Traffic Act 1988 states that it’s an offence to drive “without reasonable consideration for other persons” and according to the Crown Prosecution Service, this includes instances of “driving through a puddle causing pedestrians to be splashed”.
So, whilst the UK experiences a spell of wet weather, drivers are being urged to show more consideration towards pedestrians and cyclists – especially where puddles are concerned!
The maximum penalty of £5,000 is highly unlikely to be issued and more often than not a £100 fixed penalty notice (FPN) and three penalty points are handed out. However, the fine could increase if the offender takes it further and the case ends up in court.
“Anyone unfortunate enough to have suffered a drenching by an inconsiderate motorist splashing them when driving through a puddle would probably welcome a sizeable financial penalty for the driver,” said Pete Williams, RAC road safety spokesman.
